Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and FemFital Private Limited ("FemFital," "Company," "we," "us," or "our"), governing your access to and use of the FemFital mobile application (iOS and Android) and the website femfital.com (collectively, the "Platform").
By accessing or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Platform. These Terms supersede all prior agreements, representations, and understandings between you and FemFital regarding the Platform.
Eligibility
You must be at least 13 years of age to use the Platform. If you are under 18, you must have parental or guardian consent. By using the Platform, you represent and warrant that you meet these age requirements and have the legal capacity to enter into these Terms. If you are using the Platform on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
Account Registration & Security
- •You may create an account using your email address or through Google/Apple sign-in
- •You are responsible for maintaining the confidentiality and security of your account credentials and for all activities that occur under your account
- •You must provide accurate, current, and complete information during registration and keep it updated
- •You must immediately notify us of any unauthorized use of your account or any other breach of security
- •We shall not be liable for any loss or damage arising from your failure to maintain the security of your account

We reserve the right to modify, suspend, or discontinue any part of the Platform at any time, with or without notice, and without liability to you.
Health & Fitness Disclaimer
FEMFITAL IS NOT A MEDICAL SERVICE.
The information, recommendations, coaching, training plans, nutrition guidance, and wellness scores provided through our Platform are for general wellness and fitness purposes only. They do not constitute medical advice, diagnosis, or treatment. No doctor-patient or therapist-client relationship is created by your use of the Platform.
- •Always consult a qualified healthcare professional before starting any new exercise, nutrition, or wellness program, especially if you have pre-existing health conditions
- •If you are older than 35 years of age, have not been physically active for more than one year, or have any medical history including heart disease, high blood pressure, diabetes, bone or joint problems, or arthritis, you are required to seek medical approval prior to using the Platform
- •You must ensure that you are physically and medically fit to participate in any fitness activities recommended through the Platform
Assumption of Risk & Waiver
You acknowledge and agree that fitness and wellness activities, including strength training, yoga, mobility exercises, and nutritional changes, by their very nature include certain inherent risks that cannot be eliminated regardless of the care taken to avoid injuries. You understand that these activities involve a risk of personal injury and you are voluntarily participating with knowledge of these risks. You hereby expressly assume and accept any and all risks of injury and agree to release, waive, and forever discharge FemFital Private Limited, its directors, officers, employees, agents, coaches, and affiliates from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, or injury that may be sustained by you during or as a result of your participation in any activities recommended through the Platform, whether supervised or unsupervised.
User Conduct & Restrictions
You agree not to:
- •Use the Platform for any unlawful purpose or in violation of any applicable law
- •Attempt to gain unauthorized access to other users' data or accounts
- •Interfere with or disrupt the Platform, servers, or networks connected to the Platform
- •Share your account credentials with others or allow others to access your account
- •Use the Platform to distribute harmful, offensive, or objectionable content
- •Reverse-engineer, decompile, disassemble, or attempt to derive the source code of the application
- •Use any automated system, including bots or scrapers, to access the Platform
- •Violate the provisions of the Information Technology Act, 2000 or the SPDI Rules, 2011
Payments, Subscriptions & Refunds
- •Certain features may require a paid subscription or package purchase
- •Payments on the website are processed through a secure third-party payment gateway
- •All fees are listed in Indian Rupees (INR) unless otherwise stated and are inclusive of applicable taxes
- •Prices are subject to change at any time; changes will not affect active subscriptions until renewal
- •Refund policies are communicated at the time of purchase and may vary by package. Unless otherwise stated, all sales are final
- •We reserve the right to refuse or cancel any transaction at our sole discretion
Disclaimer of Warranties
THE PLATFORM AND ALL CONTENT, SERVICES, AND FEATURES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTY OF ANY KIND, EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING THE IMPLIED WARRANTIES OF TITLE, NON-INFRINGEMENT, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE.
WITHOUT LIMITING THE FOREGOING, FEMFITAL MAKES NO WARRANTY THAT: (A) THE PLATFORM WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS; (B) THE PLATFORM WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (C) THE RESULTS OBTAINED FROM USE OF THE PLATFORM WILL BE ACCURATE OR RELIABLE; (D) ANY ERRORS OR DEFECTS WILL BE CORRECTED; OR (E) THE PLATFORM IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM FEMFITAL OR THROUGH THE PLATFORM SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS. YOU EXPRESSLY ACKNOWLEDGE THAT USE OF THE PLATFORM IS AT YOUR SOLE RISK.
Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FEMFITAL PRIVATE LIMITED, ITS DIRECTORS, EMPLOYEES, AGENTS, COACHES, OR AFFILIATES (COLLECTIVELY, "INDEMNITEES") BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES WHATSOEVER, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, BUSINESS INTERRUPTION, PERSONAL INJURY, OR ANY OTHER LOSSES, ARISING OUT OF OR IN CONNECTION WITH:
- •Your use of or inability to use the Platform
- •Any content, information, or services obtained through the Platform
- •Unauthorized access to or alteration of your data
- •Personal injury or property damage resulting from your use of the Platform or participation in activities recommended through it
- •Any bugs, viruses, or other harmful code that may be transmitted through the Platform
- •Any conduct of third parties on the Platform
WHETHER BASED IN TORT, CONTRACT, STRICT LIABILITY, WARRANTY, OR OTHERWISE, EVEN IF FEMFITAL HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN ANY CASE, FEMFITAL'S AGGREGATE LIABILITY ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR THE SERVICES, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), WARRANTY, OR OTHERWISE, SHALL NOT EXCEED THE TOTAL AMOUNT OF FEES ACTUALLY PAID BY YOU TO FEMFITAL IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. IF APPLICABLE LAW DOES NOT PERMIT THE EXCLUSION OR LIMITATION OF LIABILITY AS SET FORTH ABOVE, THE LIABILITY OF FEMFITAL SHALL BE LIMITED TO THE MINIMUM EXTENT PERMITTED UNDER APPLICABLE LAW.
Indemnification
You agree to defend, indemnify, and hold harmless FemFital Private Limited, its directors, officers, employees, agents, coaches, and affiliates ("Indemnitees") from and against any and all losses, liabilities, claims, damages, demands, costs, and expenses (including reasonable legal fees and disbursements) asserted against or incurred by the Indemnitees that arise out of, result from, or may be payable by virtue of:
- •Your use of and access to the Platform
- •Your breach of any provision of these Terms
- •Your violation of any third-party right, including any intellectual property, privacy, or proprietary right
- •Any misrepresentation of data or information provided by you
- •Any claim that your use of the Platform caused damage to a third party
- •Your violation of any applicable law, rule, or regulation
This indemnification obligation shall survive the termination of these Terms and your use of the Platform. We reserve the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defense of such claims.
Intellectual Property
All content, features, and functionality of the Platform — including but not limited to text, graphics, logos, icons, images, audio, video, software, algorithms, and the design and arrangement thereof — are the exclusive property of FemFital Private Limited or its licensors and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws of India and international conventions.
- •You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any material from the Platform without our prior written consent
- •The FemFital name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of FemFital Private Limited
- •You may not use our trademarks without our prior written permission
Privacy
Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, store, and protect your personal data and sensitive personal data or information. By using the Platform, you consent to the data practices described in our Privacy Policy. The Privacy Policy is incorporated into and forms a part of these Terms.
Account Termination
- •You may delete your account at any time through the app (Profile → Delete My Data)
- •We may suspend or terminate your account immediately, without prior notice or liability, for any reason, including if you breach these Terms
- •Upon termination, your right to use the Platform will immediately cease
- •All provisions of these Terms which by their nature should survive termination shall survive, including but not limited to warranty disclaimers, indemnification, limitation of liability, and dispute resolution
- •Upon deletion, all your data will be permanently removed in accordance with our Privacy Policy
Force Majeure
FemFital shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemic, epidemic, fire, flood, earthquake, war, terrorism, riots, civil commotion, strikes, lockouts, government actions or orders, power outages, internet or telecommunications failures, cyberattacks, or any other force majeure event. In such circumstances, our obligations under these Terms shall be suspended for the duration of the force majeure event.
Electronic Communications
By using the Platform or contacting us via email, WhatsApp, or other electronic means, you consent to receiving communications from us electronically. You agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that such communications be in writing. You further consent to receiving service-related communications via push notifications, email, or SMS, and acknowledge that you may opt out of non-essential communications through the app settings or by contacting us.
Changes to These Terms
We reserve the right to modify or replace these Terms at any time at our sole discretion. When we make material changes, we will update the "Last updated" date at the top of this page and, where required by law, notify you via email or in-app notification. Your continued use of the Platform after any such changes constitutes acceptance of the revised Terms. It is your responsibility to review these Terms periodically. If you do not agree to the revised Terms, you must stop using the Platform.
Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles. Any disputes arising out of or in connection with these Terms or the Platform shall be resolved as follows:
1. Amicable Resolution
The parties shall first attempt to resolve any dispute amicably through good-faith negotiation within 30 days of written notice of the dispute.
2. Exclusive Jurisdiction
If the dispute cannot be resolved amicably, it shall be subject to the exclusive jurisdiction of the courts located in Bangalore, Karnataka, India.
FemFital accepts no liability for non-compliance with the laws of any country other than India. The mere fact that the Platform can be accessed from a country other than India does not imply that we accede to the laws of such country.
General Provisions
Entire Agreement
These Terms, together with our Privacy Policy and any other legal notices published by us on the Platform, constitute the entire agreement between you and FemFital concerning your use of the Platform and supersede all prior agreements and understandings.
Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, shall be severed. The remaining provisions shall continue in full force and effect.
No Waiver
Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision. Any waiver must be in writing and signed by FemFital to be effective.
Assignment
You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign our rights and obligations under these Terms without restriction, including in connection with a merger, acquisition, or sale of assets.
Relationship of Parties
Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between you and FemFital. Coaches on the platform are independent contractors, not employees of FemFital.
